Shipping, Risk of Loss and Shipment Protection
Terms version 2026-10-27 · updated Oct 29 · California law
Risk of loss passes to the Buyer when the carrier receives the Units, unless the Buyer chose Shipment Protection, in which case it passes on delivery; for pickup and own labels it passes on handover.
1. Ways to ship.
- Ground, 2-Day, Overnight: BuyiMax, on its carrier labels. Charge: Shown at checkout: the carrier's price for the order's boxes to the ship-to, or a set price, plus any handling fee; free from a stated number of units where offered
- My own label: The Buyer supplies prepaid labels; BuyiMax packs. Charge: None
- Local pickup: By arrangement; BuyiMax gives the address and a time. Charge: None
- Freight: BuyiMax, for pallets and large orders. Charge: Priced on the invoice
2. Ship-to address. Carrier labels ship only to verified addresses in the United States. An order to an address that is not verified is not shipped until it is. The Buyer may change the ship-to among its own addresses until we confirm the order; we may change it at the Buyer's request until the order ships. The order keeps the address as it was when chosen.
3. Shipment terms (BuyiMax labels, no Shipment Protection). We buy the labels after the order is paid, on a service as fast as the one the Buyer paid for or faster. Risk of loss passes to the Buyer when the carrier receives the Units. Delivery dates are the carrier's estimates; we are not liable for carrier delays. Orders above a total we set ship with a signature required.
4. Shipment Protection (delivered terms).
- 4.1 On an order shipped on BuyiMax labels, the Buyer may choose Shipment Protection at checkout, or on the order page until we confirm the order. Its charge is the percentage of the Units' value shown at checkout (1% at this version), appears on the invoice, and changes with the Units on the order. It is not offered for own labels, pickup or freight.
- 4.2 A Protected order ships on delivered terms: risk of loss stays with BuyiMax until the carrier delivers the Units to the ship-to address. Delivery recorded by the carrier at the ship-to address is delivery.
- 4.3 If a Protected shipment is lost before delivery or arrives damaged, BuyiMax, at its option, replaces the affected Units with Units of the same listing, or refunds or credits their price and their part of the Shipment Protection charge. That is BuyiMax's only obligation for loss or damage in transit.
- 4.4 To claim, the Buyer reports damage within two business days after delivery, with photos of the outer box, the packing and each damaged Unit, and keeps them for inspection; or reports a shipment with no delivery scan within 10 business days after its estimated delivery date. The Buyer cooperates with any carrier claim.
- 4.5 Shipment Protection is BuyiMax's own delivery commitment for its own goods, priced as part of the sale. It is not insurance, no insurer is involved, and it covers no other goods and no loss after delivery.
5. My own label. The Buyer uploads one prepaid label per box, for the carrier and service it chooses, at checkout or on the order page. The order is handed over only when its labels are on file. Risk of loss passes when the Buyer's carrier receives the Units. BuyiMax is not responsible for the Buyer's carrier, its rates or its claims.
6. Local pickup. Units are handed over at the place and time we arrange, to the Buyer's User or an agent the Buyer names in writing, who shows identification. Risk of loss passes on handover.
7. Shortage and transit damage. The Buyer checks each delivery against its manifest. A shortage, or visible damage to a box, is reported to wholesales@buyimax.com within two business days after delivery, with photos; we check our hand-over scans and resolve it. On orders without Shipment Protection, transit damage and loss after the carrier received the Units are the Buyer's risk, and we help with a claim against our carrier where our label was used.
8. Batteries and onward shipping. Units contain lithium batteries and ship under carrier rules. The Buyer handles any onward transport, export and disposal lawfully. Where a Buyer names a freight forwarder or exports Units, the Buyer is the exporter and is responsible for export documents, duties and sanctions compliance.
