Auction Rules
Terms version 2026-10-27 · updated Oct 29 · California law
Lots are sold online to the highest bidder at close, with reserve; a bid is a binding maximum, and the winning bid becomes an order that must be paid like any other.
1. Lots. A lot is a set of Units we list with a title, its Units' groups, a starting bid, a bid increment, an opening and a closing time, and in some lots a reserve price that is not shown. Signed-in Buyers see each Unit's grade, battery band (never the percentage), test result, device status and IMEI while the lot is open. After the close, the lot's list stays visible to other Buyers for 7 days; IMEIs only to the winner.
2. Who may bid. Users with the owner or purchaser role of an approved Buyer whose account is not suspended and has accepted the current Terms. A bid must fit within the Buyer's unpaid-hold limit.
3. Bids are maximums. A bid states the most the Buyer will pay for the whole lot. The Site bids for the Buyer only as much as needed: one increment above the next-highest maximum, never above the Buyer's own. Equal maximums go to the earlier bid. When the leading maximum reaches the reserve, the price rises to the reserve. Maximums stay hidden from everyone, including BuyiMax staff, until the lot ends.
4. Binding bids and withdrawal. A bid binds the Buyer until the lot closes, except that, after we change a lot (for example by removing a Unit), each bidder may withdraw all of its bids placed before the change, at once, until the posted close, without a strike.
5. Extensions and pauses. A bid placed in the last 5 minutes extends the close by 5 minutes. If a Unit in an open lot is no longer available, we pause the lot and tell its bidders; we then remove the Unit and resume it, with the time left restored, or cancel the lot.
6. Watching. A Buyer may watch a lot; watchers are told when it opens and, unless they lead, 30 minutes before it closes.
7. Close and award. At the close, the highest maximum at or above any reserve wins at the current price, and the Site creates an order for the winner, which is binding and is paid under the Payment Terms. If a Unit left our stock before the win could be checked, we may award the remaining Units at the same price per Unit, or cancel the lot. A lot with no bid, or whose reserve is not met, is not sold. A winner whose account is suspended at the close receives no order.
8. Fair bidding. BuyiMax, its employees and anyone acting for them never bid on a lot. Buyers do not bid together to hold prices down, use more than one account to bid on a lot, or bid without intending to pay.
9. Our rights. Lots are offered with reserve: we may withdraw a lot or a Unit at any time before the close is announced. We may cancel a bid, or the result of a lot, that breaks these rules or results from an obvious error, and tell the bidders affected.
10. Non-payment. An unpaid winning order is cancelled and adds a strike under the Payment Terms; we may offer the lot to others.
